REGULAR MEETING – ZONING BOARD OF APPEALS – CITY OF NOVI
Monday, November 4, 2002 – 7:30 p.m.

Rules of Conduct:

  1. Each person desiring to address the Board shall state his / her name and address.
  2. Individual persons shall be allowed five (5) minutes to address the Board, an extension of time may be granted at the discretion of the Chairperson.
  3. There shall be no questioning by the audience of the persons addressing the Board; However, the Board members may question that person with recognition of the Chairperson.
  4. No person shall be allowed to address the Board more than once unless permission is granted by the Chairperson.
  5. One spokesperson for a group attending shall be allowed ten (10) minutes to address the Board.

Public Remarks

1) Case No. 02-076 filed by Don Henry of Tomco Fabricating, Inc. at 25155 Haggerty

Don Henry of Tomco Fabricating, Inc. is requesting a use variance to allow outdoor storage in an I-1 Light Industrial Zoning district for the property located at 25155 Haggerty Road. The property was zoned I-2 which permitted outdoor storage related to the business use only and required an eight (8) foot high obscuring wall around the property.

CITY OF NOVI, CODE OF ORDINANCE, Article 19, Section 1905 "Required Conditions" states that all uses within an I-1 Zoning District shall be conducted within a completely enclosed building.

The applicant is requesting to maintain the outdoor storage on his property.

2) Case No. 02-083 filed by John Carroll representing Novi Party Store at 43025 Grand River

John Carroll of Carroll Installations representing Novi Party Store is requesting two (2) sign variances to erect two (2) thirty (30) square foot illuminated wall signs on the east elevation at 43025 Grand River.

 

CITY OF NOVI, CODE OF ORDINANCE, Section 28-6(3) states:

"…no building or parcel of land shall be allowed more than one sign permitted under this section…"

The applicant is requesting permission to erect a thirty (30) square foot wall sign with verbiage to read "Novi Party Store."

The applicant is requesting permission to erect a thirty (30) square foot wall sign. The verbiage will be determined when a future tenant is found.

3) Case No. 02-090 filed by Douglas Heath of 905 South Lake Drive

Douglas Heath is requesting a three (3) foot front yard setback variance for the construction of a proposed addition in the front of the residence located at 905 South Lake Drive, Idlemere Park Subdivision. The property is zoned R-4 and the proposed construction does not increase the non-conformity for the side yards to the existing building.

CITY OF NOVI, CODE OF ORDINANCE, Article 24, Section 2400 "Schedule of Regulations" requires a minimum front yard setback of thirty (30) feet.

Required front yard setback: 30 feet

Proposed: 27 feet

Variance: 3 feet

4) Case No. 02-087 filed by Mozart Homes LLC for Brookhaven Subdivision located at 42400 Ten Mile Road

Paul Hedemark of Mozart Homes LLC is requesting one (1) sign variance to erect a twenty five (25) square foot ground sign on property located at 42400 Ten Mile Road.

CITY OF NOVI, CODE OF ORDINANCE, Section 28-7(3) "Temporary signs" states:

Sign function – "Residential business sale, rental or lease sign which identifies the sale, rental, or lease of the property upon which the sign is located or the model name of the building for sale, but not including signs on vacant unplatted property."

Area square feet (allowed): 6 square feet

Proposed: 25 square feet

Variance: 19 square feet

 

 

5) Case No. 02-093 filed by Arnold Randy Schmitt representing the Bamboo Club at 44375 Twelve Mile (Fountain Walk)

Arnold Randy Schmitt of Allied Signs, Inc. representing the Bamboo Club is requesting two (2) sign variances to erect two (2) illuminated wall signs at 44375 12 Mile Road in the Fountain Walk development. Please note: the first sign is permitted per code.

CITY OF NOVI, CODE OF ORDINANCE, Section 28-6(3) states:

"…no building or parcel of land shall be allowed more than one (1) sign permitted…"

The applicant is requesting permission to erect a second wall sign.

CITY OF NOVI, CODE OF ORDINANCE, Section 28-6(2)b.1.(a)i.a. states:

"A wall sign displayed on a building occupied by two (2) or more businesses shall not exceed twenty four (24) square feet or one (1) square foot of signage for every two (2) lineal feet of business frontage to a maximum of forty (40) square feet."

Requested: 54 square feet

Permitted: 40 square feet

Variance: 14 square feet

6) Case No. 02-094 filed by Beverly White representing Westmarket Square

Beverly White of Juxtapose Sign Studio representing Westmarket Square is requesting an extension of their previously approved sign variance (Case No. 01-077). The variance was granted on September 18, 2001 for an extension of six months or until leased. At the October 1, 2002 meeting the Zoning Board of Appeals determined that the sign should be removed. The sign is located on the northwest corner of Beck Road and Grand River.

The applicant is requesting permission to allow the sign to remain for a time period of one year or an appropriate amount as determined by the Board.

7) Case No. 02-095 filed by Neal Ryan at 24360 Willow Lane

Neal Ryan is requesting a six (6) foot rear yard setback variance for the construction of an attached garage located at 24360 Willow Lane in the Willowbrook Subdivision. The property is zoned R-4.

CITY OF NOVI, CODE OF ORDINANCE, Article 24, Section 2400 "Schedule of Regulations" requires a minimum rear yard setback of thirty five (35) feet.

Required rear yard setback: 35 feet

Proposed: 29 feet

Variance: 6 feet

8) Case No. 02-096 filed by Kelly & Mike Haynes at 112 Maudlin

Kelly & Mike Haynes are requesting a ten (10) foot front yard setback variance for the construction of a covered porch for an existing home located at 112 Maudlin. The proposed covered porch is to replace the existing porch / deck. The property is zoned R-4.

CITY OF NOVI, CODE OF ORDINANCE, Article 24, Section 2400 "Schedule of Regulations" requires a minimum front yard setback of thirty (30) feet.

Required front yard setback: 30 feet

Proposed: 20 feet

Variance: 10 feet

9) Case No. 02-097 filed by Greg Eitelman of Roche Bobois at 43221 Twelve Mile Road

Greg Eitelman, owner of Roche Bobois is requesting three (3) sign variances to erect two (2) wall signs and one (1) ground sign at 43221 12 Mile Road (Hagopian Rugs building). Please note: the previous variance requests were limited to Hagopian Rugs only.

Sign A (replacing one existing "Hagopian" sign on southeast elevation of building facing ring road):

"That in Case No. 98-016B the variance request be granted to allow a 50 square foot wall sign to be placed on the building facing the mall ring road."

The applicant is requesting permission to erect a fifty (50) square foot illuminated wall sign to read "Roche Bobois, Paris."

Sign B (additional wall sign on north elevation of the building):

The applicant is requesting permission to erect a fifty (50) square foot illuminated wall sign to read "Roche Bobois, Paris."

Sign C (additional signage to existing ground sign):

"That in Case No. 98-016D the variance request be granted to allow a 3 square foot ground sign."

The applicant is requesting permission to add the verbiage "Roche Bobois" to the existing ground sign.
