CONSENT AGENDA - REMOVALS AND APPROVAL

1. BECK NORTH CORPORATE PARK UNIT 9, SP07-45

Consideration of the request of Dot Development for a one-year Preliminary Site Plan extension. The subject property is located in Section 4, at the northeast corner of Hudson Drive and DeSoto Court in the Beck North Corporate Park development. The subject property is approximately 2.39 acres and the applicant is proposing to construct a 31,156 square foot speculative industrial building.

A motion to approve the September 30, 2009 Consent Agenda. Motion carried 6-0.

PUBLIC HEARINGS

1. WRENCHERS GARAGE, SP09-25

Public Hearing of the request of Roy Baker for Preliminary Site Plan, Special Land Use Permit and Stormwater Management Plan approval. The subject property is located in Section 15, south of Grand River Avenue, east of Lanny’s Road and west of the CSX Railroad, in the I-1, Light Industrial District. The subject property is approximately 1.4 acres and the applicant is proposing to locate an automotive service business in the existing building, reconstruct part of the parking lot and make minor building improvements at 44455 Grand River Avenue.

In the matter of Wrenchers Garage, SP09-25, motion to approve the Special Use Permit for an automotive service establishment subject to the following: a) Obtaining a variance from the Zoning Board of Appeals from the following special requirements for automotive service establishments: 1. Minimum lot area from 2.0 acres to 1.4 acres; 2. Parking in front and exterior side yards; and 3. Overhead door facing major road

Obtaining a Zoning Board of Appeals variance for parking spaces required from 68 to 20; c) Providing an acceptable noise impact statement; For the reason that the Planning Commission finds that relative to other feasible uses of the site, the proposed automotive service establishment use: a) Will not cause any detrimental impact on existing thoroughfares or the capabilities of public services and facilities; b) Is compatible with the natural features and characteristics of the land and adjacent uses of land; c) Is consistent with the goals, objectives and recommendations of the City’s Master Plan for Land Use; d) Will promote the use of land in a socially and economically desirable manner; e) Is (1) listed among the provision of uses requiring special land use review as set forth in the various zoning districts of this Ordinance, and (2) is in harmony with the purposes and conforms to the applicable site design regulations of the zoning district in which it is located. Motion carried 8-0.

In the matter of Wrenchers Garage, SP 09-25, motion to approve the Preliminary Site Plan, subject to the following: a) Obtaining a Zoning Board of Appeals variance to reduce the front yard parking lot setback from 40 feet to 10 feet; b) Reconfiguring the parking spaces on the west side of the building to permit access to all entrance doors; c) Planning Commission waiver of the landscape berm requirement along Lannys Road due to existing conditions; d) Planning Commission waiver of the street tree requirements due to lack of available space; e) Planning Commission granting of a Section 9 waiver because the proposed design will add interest and enhance the overall appearance of the building; f) Replacing the proposed ribbed metal panels with flat metal panels; g) The conditions and items listed in the staff and consultant review letters being addressed on the Final Site Plan; For the following reasons because it is otherwise in compliance with Article 19, Section 2400 and Article 25 of the Zoning Ordinance and all other applicable provisions of the Ordinance. Motion carried 8-0.

In the matter of Wrenchers Garage, SP 09-25, motion to approve the Storm Water Management Plan, subject to: a) The conditions and items listed in the staff and consultant review letters being addressed on the Final Site Plan; For the following reasons because it otherwise in compliance with Chapter 11 of the Code of Ordinances and all other applicable provisions of the Ordinance. Motion carried 8-0.

2. ZONING ORDINANCE TEXT AMENDMENT 09-125.22

Public Hearing for Planning Commission’s recommendation to City Council for an ordinance to amend Article 5, Wetlands and Watercourse Protection, to amend the City Code related to an update to the Wetland and Watercourse Protection Ordinance and revised Regulated Wetland and Watercourse Map.

In the matter of the Amended Regulated Wetland Map and Amended Wetland Ordinance Text Amendment 09-125.22, a motion to recommend approval of the Amended Regulated Wetland Map and Amended Wetland Ordinance to City Council. Motion carried 8-0.

MATTERS FOR CONSIDERATION

1. Novi Town Center Building G DemoLITION, SP09-22

Consideration of the request of Novi Town Investors, LLC, for a recommendation to City Council for Preliminary Site Plan approval and a Section 9 Façade Waiver. The subject property is located east of Novi Road, north of Grand River Avenue, in the TC, Town Center District. The applicant is proposing to demolish portions of Building G and construct a parking lot and associated landscaping in its place.

In the matter of Novi Town Center Building G Demo, SP 09-22, motion to recommend approval to City Council for the Preliminary Site Plan subject to the following: a) Section 9 Facade Waiver, for the use of non-copper colored standing seam metal in the Town Center District; b) Landscape waiver for the lack of foundation landscaping along the remainder of Building G; c) Landscape waiver for the lack of irrigation for proposed plantings; d) The applicant making the appropriate changes to address all of the concerns noted in the Fire Marshall’s review letter and adequately addressed on the supplemental plan submitted on September 15, 2009; e) The conditions and items in the staff and consultant review letters being addressed on the Stamping Set submittal; For the reason that it is otherwise in compliance with Article 25 and Article 16 of the Zoning Ordinance and all other applicable provisions of the Ordinance and the proposed façade is consistent with the overall Town Center development and will generally enhance the visual quality of the project, the color selections are carefully coordinated and will harmonize with both new and existing materials, the use of the selected façade materials and material combinations will not detract from the future development of buildings with facades of brick and stone. Motion carried 8-0.

2. NOVI FOOD CENTER, SP09-18

Consideration of the request of Novi Food Center, LLC, for Preliminary Site Plan and Stormwater Management Plan approval. The subject property is located in Section 23, south of Grand River Avenue between Sixth Gate and Main Street, in the TC-1, Town Center District. The applicant proposes to expand, reconfigure and pave parking areas on the north and south side of the property including improvements in the adjacent Grand River Avenue right-of-way.

In the matter of Novi Food Center Parking Lot Improvements, SP 09-18, motion to approve the Preliminary Site Plan, subject to the following: a) Obtaining a setback variance for three parking spaces and adjacent access aisles from the Zoning Board of Appeals; b) Increasing the north driveway width from 22 feet to 24 feet on the Final Site Plan; c) Provide alternative location for landscape amenities as offered by the applicant in their response letter; d) Planning Commission waiver of the required Town Center parking area wall for the reasons that the wall would be limited in length and would restrict clear vision at the entrances; e) Planning Commission waiver of the same side and opposite side driveway spacing waiver; f) Resolution of ownership issues with the City of Novi regarding former Road Commission right-of-way adjacent to Grand River Avenue with an appropriate agreement between the applicant and the City allowing or facilitating the use of this area by the applicant; g) Applicant working with City Attorney to provide cross access easements at the time of Final Site Plan approval; h) The conditions and items listed in the staff and consultant review letters being addressed on the Final Site Plan; For the following reasons because it is otherwise in compliance with Article 16, Section 2400 and Article 25 of the Zoning Ordinance and all other applicable provisions of the Ordinance. Motion carried 8-0.

In the matter of Novi Food Center Parking Lot Improvements, SP 09-18, motion to approve the Storm Water Management Plan, subject to: The conditions and items listed in the staff and consultant review letters being addressed on the Final Site Plan; For the following reasons because it is otherwise in compliance with Chapter 11 of the Code of Ordinances and all other applicable provisions of the Ordinance. Motion carried 8-0.

3. SET A PUBLIC HEARING FOR ZONING ORDINANCE TEXT AMENDMENT 18.238 REGARDING FAST FOOD RESTAURANTS IN THE B-3, GENERAL BUSINESS DISTRICT

A motion to set a Public Hearing for Zoning Ordinance, Text Amendment 18.238 regarding Fast Food Restaurants in the B-3 General Business District. Motion carried 8-0.
