SPECIAL MEETING OF THE COUNCIL FOR THE CITY OF NOVI

MONDAY, MARCH 24, 1997 - 6:00 P.M.

Mayor McLallen called the meeting to order at 6:05 P.M.

 

 

 

ROLL CALL: Mayor McLallen, Mayor Pro Tem Crawford, Council Members Clark, Kramer (absent/excused), Mitzel, Mutch, Schmid (absent/excused)

 

 

ALSO PRESENT: Assistant City Manager Craig Klaver, Assistant City Attorney Dennis Watson, City Clerk Tonni Bartholomew

 

 

AUDIENCE PARTICIPATION - None

 

 

PURPOSE OF SPECIAL MEETING: To call an Executive session of City Council for the purpose of Union Negotiations and Pending Litigation and to approve a Temporary Sewer Agreement - McLallen, 21066 Cambridge Drive

 

 

1. Schedule an Executive Session for the purpose of Union Negotiations and Pending Litigation

Nay: None

 

Mayor McLallen stated because Item 2 directly affects her, she will abstain from voting and will turn the meeting over to Mayor ProTem Crawford.

 

 

2. Approval of Temporary Sewer Agreement - McLallen, 21066 Cambridge Drive

 

Mr. Watson asked Council to recall that there have been several cases where the City does not have a sewer infrastructure directly affronting property. In these instances, the City has allowed property owners temporarily to tie into the infrastructure by way of easements through other private property. Mr. Watson noted they most recently accomplished this with Mark Churella. Mr. Watson believes it became evident to the Mayor now that Mr. Churella is ready to go forward and tie into a private sewer, that it would be possible for her to tie into the same connection. Mr. Watson explained the agreement before Council is essentially identical to the Churella agreement that allows for that connection. However, it is understood when the actual public infrastructure is available in the area, the temporary connection will cease and the property must tie into the regular sewer main.

 

Mayor ProTem Crawford stated this agreement is then in order in conjunction with the Churella agreement. Mr. Watson stated Mayor ProTem Crawford was correct.

COUNCIL DISCUSSION

 

Mr. Watson reported that the agreement itself indicates in addition to the cost of any construction, the responsibility for obtaining any property rights or easements is to be assumed by the property owner.
